EEOC PublicationsThe Equal Employment Opportunity Commission (EEOC) issued a Compliance Manual that provides guidance and instructions for investigating and analyzing issues that arise with regard to life and health insurance benefits, long-term and short-term disability benefits, severance benefits, pension or other retirement benefits, and early retirement incentives. This Compliance Manual addresses the application of the federal non-discrimination laws (the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), Title VII of the Civil Rights Act, and the Equal Pay Act) to various employee benefits. Although the manual is intended to provide guidance and instructions for EEOC investigators, it also provides useful information for employers who may wish to know how the EEOC views these issues. The EEOC also issued Questions and Answers concerning the Compliance Manual Section on employee benefits. According to the EEOC, this publication summarizes the most important points in the benefits chapter of the Compliance Manual. In August 2001, the EEOC rescinded portions of its Compliance Manual concerning the application of ADEA to retiree health benefits.
