Strict liability for FMLA claimsThe Connecticut Supreme Court has ruled that “interference” claims under the Family and Medical Leave Act (FMLA) — i.e., claims that an employer interfered with an employee’s FMLA rights — should be evaluated using a “strict -liability” framework. This means that an employee can prevail in an interference claim without proving that the employer had improper intent.
