Employer's right to withhold disputed portion of a wage applies only to the most recent pay periodIn the recent case of Connecticut v. Lattanzio, a state Superior Court held that the provision of Connecticut's wage payment law requiring an employer to promptly pay any undisputed portion of wages does not authorize an employer to offset against those wages any claim for the return of past overpayments or other claims against the employee. Rather, a deduction may be made only if there is a dispute over the amount due for the most recent pay period.
