The Department has updated the state’s hazardous waste management
regulations to incorporate the federal hazardous waste regulations as
of January 1, 2001. The Department updated the regulations in two phases.
The first phase was completed on October 31, 2001 with the adoption of
revised state regulations which incorporated Title 40 of the Code of Federal
Regulations (40 CFR) Parts 260-279 and Part 124 as of July 1, 1995. The
Department has now completed the second phase of the update process through
the adoption of revised state hazardous waste regulations which incorporate
40 CFR Parts 260-279 and Part 124 as of January 1, 2001. The Department
has done so by incorporating by reference the federal rules as of July
1, 2000 and adding, when required, the rules promulgated by EPA between
July 1, 2000 and January 1, 2001.
