Aggressive changes to eminent domain laws rejected
(May 16, 2006) Modifying and restricting the use of eminent domain, at least in instances where it is used for economic development purposes, was a hot topic as the session began in February. No fewer than four bills and a bevy of amendments were filed, most of which would have heavily restricted the use of eminent domain.
CBIA opposed the overly-aggressive proposals because eminent domain has proved to be a very important tool in many major economic development projects throughout the state.
Ultimately, the legislature elected to not change the eminent domain laws but rather to establish an Office of Property Rights Ombudsman that will provide information and mediation resources to property owners who may be the subject of an eminent domain proceeding.
