House prepares to move brownfield
legislation

(May 15, 2009) For the past several weeks, negotiations have been taking place at the Capitol focused on drafting brownfield legislation that will garner broad support in the legislature.

A final draft proposal, replacing the existing language of HB-6097, is expected on Monday, May 18, and the revised bill could be considered by the House later next week.

Significant components that are expected to be in the negotiated bill include: clarifying and bolstering municipal liability relief; strengthening opportunities to recover cleanup costs from potentially responsible parties; and establishing a new liability limits for entities, including private developers, that take ownership of certain brownfields to remediate and redevelop them.

Brownfields are properties that carry the stigma of real or perceived contamination that generally stems from Connecticut’s rich industrial legacy. The also carry the great potential to be areas of economic growth, once they are redeveloped.
