NLRB Postpones Posting Requirement
The National Labor Relations Board (NLRB) is postponing its employee rights posting rule: scheduled to take effect on April 30, 2012: until the legal issues are resolved in court.
The rule would require most private employers to display a notice informing employees of their rights under the National Labor Relations Act (NLRA). In March, the D.C. Circuit Court had ruled that the Board had the authority to promulgate the rule; in April, the South Carolina Circuit ruled that it did not. In light of the conflicting opinions, the D.C. Court of Appeals followed on April 17 with an injunction blocking the posting rule.
The NLRB plans to appeal the South Carolina decision and will also appeal a part of the D.C. opinion that raised questions about the rule’s enforcement mechanisms.
