NLRB Delays Poster Mandate

The NLRB has postponed the implementation date for its new notice-posting rule by more than two months.
The new effective date of the rule is now Jan. 31, 2012. The rule was originally slated to go into effect on November 14, but was pulled in response to a lawsuit from a number of national business groups, including the U.S. Chamber of Commerce, the National Association of Manufacturers, and the National Federation of Independent Business. A hearing date on the suit has been set for December 19 with a decision to be made before the new effective date of January 31.
The rule requires private sector employers within the NLRB’s jurisdiction to display a workplace poster that describes employee rights under the National Labor Relations Act. Employers who customarily post personnel rules or policies on an internet or intranet site must also provide a link to the rights poster from those sites. If at least 20% of an organization’s workforce does not speak English, the notice must be posted in appropriate languages.
Employers who fail to display the poster will be cited for unfair labor practice.
