As the deadline nears for federal contractors, companies with 100 or more employees, and Medicare and Medicaid-certified healthcare providers, employers face a series of pending responsibilities. 

An executive order signed by President Joe Biden in September requires that employees of federal contractors and subcontractors are fully vaccinated against COVID-19 by Jan. 18.

Other covered employers face a Jan. 5, 2022 deadline for compliance or have unvaccinated employees test weekly for COVID-19.

The U.S. Centers for Medicare and Medicaid Services issued an interim rule Nov. 5 mandating COVID-19 vaccinations for healthcare employees at Medicare and Medicaid-certified providers.

OSHA’s Nov. 4 Emergency Temporary Standard applies to private sector employees with 100 or more employees. It allows for a weekly testing option for unvaccinated employees. 

The ETS was challenged and is currently on pause while it is reviewed by the federal courts. Those challenges do not impact the executive order governing federal contractors.

HR specialists and CBIA are advising covered private sector employers to continue as if the OSHA ETS will take effect. 

The deadline for companies to comply with recordkeeping requirements and implement mask mandates for unvaccinated employees is Dec. 5. 

“Be prepared,” DiPentima said. “The last thing you want to do is put everything on hold and not have policies in place by Dec. 5.”
