Wage payment laws can be complex and confusing, frequently leading to inadvertent employer error resulting in liability for back wages, fines and penalties, and even the claimantโ€™s attorneyโ€™s fees.

In this Dec. 6, 2023 HR Hotline Live, CBIA’s Diane Mokriski joined Carmody Torrance Sandak & Hennessey attorneys Vincent Farisello and Nick Zaino to discuss common wage and hour mistakes made by employers.

They discussed the U.S. Department of Laborโ€™s definition of โ€œexemptโ€ employees, what this classification means, and why employers cannot โ€œmakeโ€ an employee salaried exempt, even if the worker requests it.

They also reviewed common traps for the unwary, such as the inappropriate employment of minors, knowing when to pay interns, and how to calculate overtime when a worker has two rates of pay.

And they answered frequently asked questions, including:ย 

  • Do we have to pay for travel time when an employee travels overnight?
  • Are we required to pay an employee whoโ€™s home, but on call?
