Bias Charges Hit Record High

The Equal Employment Opportunity Commission (EEOC) reports that private sector workplace discrimination filings hit a record high of 99,922 during fiscal year 2010, which ended Sept. 30, 2010.

All major categories of charge filings increased. For the first time ever, retaliation (36,258 charges) under all statutes surpassed race (35,980) as the most frequently filed charge. Historically, race had been the most frequently filed charge since the EEOC became operational in 1965. The agency also received 201 charges under the Genetic Information Nondiscrimination in Employment Act in its first year of enforcement.

The EEOC data also show that the agency filed 250 lawsuits, resolved 285 lawsuits, and resolved 104,999 private sector charges. Through its combined enforcement, mediation, and litigation programs, the EEOC secured more than $404 million from employers, the highest level of monetary relief ever obtained.

Despite the increase in charges, the EEOC slowed the growth of its charge inventory, ending the year with 86,338 pending charges, an increase of less than 1%.
