The USDOL has issued a notice answering employers’ frequently asked questions (FAQs) related to automatic reenrollment, employer shared responsibility payments, and waiting periods under the new Patent Protection and Affordable Care Act.

Issued in substantially identical form by the departments of the Treasury and Health and Human Services, the notice addresses questions and invites comments on proposals that the departments expect to include in future guidance and rulemaking.

Public comments are requested by April 9, 2012 and may be sent electronically to e-ohpsca-er.ebsa@dol.gov. They may also be sent via mail or hand delivered to: Office of Health Plan Standards and Compliance Assistance, Employee Benefits Security Administration, Room N-5653, U.S. Department of Labor, 200 Constitution Avenue, NW, Washington, DC 20210.

Comments will be shared by the departments, who caution that no personally identifiable information (such as name, address, or other contact information) or confidential business information be included. All comments are posted on the Internet as received, and can be retrieved by most Internet search engines.
